These Terms of Service (the "Terms") govern your access to and use of Hypnoero (hypnoero.com) and related services (the "Service"), operated by La Salida Ltd, a company incorporated in the British Virgin Islands ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility and Age Requirement
The Service contains sexually explicit audio content intended for adults only. You must be at least 18 years of age, or at least 21 years of age where required by the laws of your jurisdiction, to access or use the Service. By using the Service, you represent and warrant that you meet the applicable age requirement and that accessing adult content is legal in your location. You are solely responsible for verifying that your use of the Service complies with the laws that apply to you, and for preventing access by minors through any device or account under your control.
2. Description of the Service
Hypnoero allows you to describe your preferences, desires, and boundaries, after which an artificial intelligence system writes and records personalized erotic hypnosis audio. All content on the Service is synthetic, AI-generated audio. There are no performers, no user-uploaded sexual imagery, and no live content. All scenarios, characters, and voices in generated audio are fictional and computer-generated.
3. Fictional Entertainment; No Medical Claims
All content provided through the Service is fictional fantasy audio intended for personal entertainment and adult wellness purposes only. The Service is NOT therapy, hypnotherapy treatment, medical care, or a substitute for professional medical or mental health advice, diagnosis, or treatment. We make no medical or therapeutic claims of any kind. If you have a medical or mental health condition, consult a qualified professional. Do not listen to hypnosis audio while driving, operating machinery, or performing any activity that requires your full attention.
4. Accounts
You must register an account to use certain features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to notify us promptly at support@hypnoero.com of any unauthorized use of your account.
5. Prohibited Uses
You agree not to use the Service to request, generate, or attempt to generate:
- Any content involving minors, or any content that sexualizes, depicts, or references persons under 18 years of age in any way. We maintain a zero tolerance policy: any such request will result in immediate and permanent termination of your account, and may be reported to law enforcement.
- Content depicting non-consensual sexual activity involving real, identifiable persons, or content intended to harass, defame, impersonate, or harm any real person.
- Content that is illegal in your jurisdiction or that violates any applicable law or regulation.
- Content promoting violence, self-harm, human trafficking, or bestiality.
You also agree not to reverse engineer, scrape, resell, or redistribute the Service or its content except as expressly permitted by these Terms, and not to interfere with the operation or security of the Service.
6. Intellectual Property and License to Generated Audio
The Service, including its software, design, branding, voices, models, and underlying technology, is owned by La Salida Ltd or its licensors and is protected by applicable intellectual property laws. Subject to your compliance with these Terms and payment of any applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use audio generated for you through the Service for your personal, non-commercial use only. You may not sell, license, publicly distribute, or commercially exploit generated audio without our prior written consent.
7. Subscriptions and Payments
Certain features require a paid membership. Membership payments are processed by third-party payment processors. Billing terms, cancellation, and refunds are described in our Cancellation and Refund Policy, which is incorporated into these Terms by reference.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT GENERATED CONTENT WILL MEET YOUR EXPECTATIONS OR BE AVAILABLE AT ANY PARTICULAR TIME.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LA SALIDA LTD AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
10. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, including immediately and permanently for any violation of Section 5. Upon termination, your license to generated audio ends, and provisions of these Terms that by their nature should survive termination will survive.
11. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will post the updated Terms on this page and update the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the British Virgin Islands, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the British Virgin Islands.
